摘要：2013年修改了《消费者权益保护法》，但我国现行的《消费者权益保护法》中对于消费者的定义并不明确，理论界对于知假买假者是否认定为消费者有很多争议。本文是以案例为切入点，对使用知假买假手段，是否影响消费者身份的认定，结合相关理论，通过分析知假买假行为及消费者认定条件，来分析知假买假”者是否属于消费者。

On Consumer Identity Recognition of Knowledgeable and Fake Buyers: A Case Study of Dispute over Sale Contract between Wang Hai and Wuxi Tourist Outdoor Goods Co., Ltd.
Abstract: The Consumer Rights Protection Law was amended in 2013, but the definition of consumers in the current Consumer Rights Protection Law of China is not clear. There are many disputes in the theoretical circles about whether the person who knows to buy fake is identified as a consumer. This article is based on the case as a starting point, whether the use of knowledgeable and fake means of buying fake affect the identification of consumers, combined with relevant theories, through the analysis of knowledgeable and fake buying behavior and consumer identification conditions, to analyze whether knowledgeable and fake buyers belong to consumers.
